These Terms & Conditions (“Terms”) govern your access to and use of the website and services offered by KOVANS VENTURES PRIVATE LIMITED under the brand bucketlistt (collectively, “we”, “us”, or “bucketlistt”) at https://bucketlistt.com (“Platform”). By using the Platform, browsing listings, creating an account, or making a booking, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Nature of the service

bucketlistt operates as an online marketplace and technology platform that connects you with independent third-party activity operators, vendors, and experience providers (“Operators”). Unless expressly stated otherwise on a booking, bucketlistt is not the direct seller or performer of the adventure activity; the Operator is responsible for delivering the experience in a safe and lawful manner and for complying with applicable permits, insurance, and local regulations.

Operators remain solely responsible for the safety of the activity, obtaining and maintaining required permits and licences, insurance, equipment, staff, training, and the execution and on-site delivery of the activity. bucketlistt only provides the marketplace and related technology services to facilitate discovery, booking, and payment.

Booking through bucketlistt does not create an employer–employee, agency, partnership, or joint venture relationship between bucketlistt and any Operator.

2. Eligibility & accounts

You must be at least 18 years old to create an account and enter into binding bookings, or you must act through a parent or legal guardian who accepts these Terms on your behalf.

You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorised use of your account.

3. Listings, descriptions & availability

Activity descriptions, images, prices, inclusions, meeting points, weight or age limits, medical restrictions, and schedules are provided by Operators or sourced from them. While bucketlistt strives to keep information accurate and up to date, details may change without notice. The Operator’s confirmation and on-site briefing prevail where there is a conflict with generic marketing copy on the Platform.

4. Bookings & confirmation

A booking request or payment on the Platform does not always mean immediate final confirmation. Some experiences require Operator acceptance, slot availability, weather clearance, or document checks. You will receive communication (e.g. email, SMS, or in-app notice) when your booking is confirmed or if it cannot be fulfilled. You are responsible for arriving on time with valid ID and meeting health and safety requirements stated for that activity.

5. Pricing & payments

Prices displayed are set by Operators or bucketlistt as agreed with Operators and may include taxes or fees as indicated at checkout. bucketlistt or its payment partners may collect payments (including partial payments such as “pay only a percentage to book” where offered). You authorise us and our payment processors to charge your selected payment method for the amounts shown at checkout.

Chargebacks or payment disputes must be raised in good faith after contacting support; abusive or fraudulent chargebacks may lead to account suspension.

6. Your responsibility when booking activities

By using bucketlistt to browse, select, or book any activity, you acknowledge that you do so voluntarily and that you—not bucketlistt—are responsible for deciding whether an activity is suitable for you, for meeting eligibility, health, weight, age, and fitness requirements stated by the Operator, and for following all safety briefings, waivers, and on-site instructions. You agree to accept the activity-specific terms, rules, and conditions shown at checkout or provided by the Operator before you participate; if you do not agree, you must not complete the booking or attend the activity.

bucketlistt provides the Platform and, where applicable, payment collection as an intermediary between you and the Operator. The performance, supervision, insurance, permits, and safe delivery of the activity itself are the responsibility of the Operator, not bucketlistt, except where mandatory consumer protection or other laws impose obligations on bucketlistt that cannot be limited by contract. Nothing in this section overrides non-waivable rights you may have under applicable law.

7. Cancellations, rescheduling & refunds

Cancellation, refund, and rescheduling rules depend on the specific activity, Operator policy, and the terms shown on the booking page at the time of purchase. Some bookings may be non-refundable after a cut-off time, or refundable only through bucketlistt where we have agreed to process refunds on behalf of the Operator. If you cancel within the permitted window, refunds (if any) are typically returned to the original payment method within a reasonable period, subject to bank or payment partner processing times.

Operator-initiated cancellations (e.g. weather, safety, minimum group size not met) will be handled according to the applicable policy communicated to you; bucketlistt will use reasonable efforts to facilitate refunds or alternatives where we are contractually able to do so.

8. Force majeure

bucketlistt shall not be responsible or liable for any delay, cancellation, failure, or inability to perform arising from or related to events beyond its reasonable control, including but not limited to weather conditions, floods, landslides, natural disasters, strikes, transport disruption, pandemics, epidemics, government restrictions, acts of God, war, terrorism, civil unrest, or other events beyond reasonable control. In such cases, applicable Operator cancellation, rescheduling, or refund policies will apply as communicated to you.

9. Conduct & prohibited use

You agree not to:

• Misuse the Platform, scrape data, interfere with security, or attempt unauthorised access to systems or other users’ accounts
• Provide false identity, payment, or medical information relevant to participation in an activity
• Harass Operators, staff, or other customers, or engage in unlawful behaviour on or off the Platform in connection with a booking

We may suspend or terminate access for violations of these Terms or applicable law, including without limitation where we reasonably believe there has been fraudulent bookings, payment abuse, use of fake identities, misuse of promotions or referral offers, chargeback fraud, or security threats to the Platform, users, or Operators.

10. Health, fitness & assumption of risk

Adventure activities (including but not limited to bungee jumping, rafting, paragliding, zip-lining, and similar sports) involve inherent risks. You confirm that you are in adequate health, have disclosed relevant medical conditions where required, and will follow all safety instructions and equipment rules given by the Operator. You are responsible for disclosing medical conditions, disabilities, injuries, or other health-related information where required by the Operator or applicable activity rules. Failure to disclose such information may result in denial of participation without refund where permitted by the applicable cancellation policy and law. bucketlistt does not warrant that any activity is free of risk. Participation is at your own risk to the extent permitted by law.

Certain activities may require emergency contact information. Where requested, you must provide accurate and complete emergency contact details, and you are responsible for ensuring that such information remains current.

11. Limitation of liability

To the maximum extent permitted by applicable law in India, bucketlistt and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Platform or participation in any Operator-led activity.

Where liability cannot be excluded, our aggregate liability arising out of or related to these Terms or the Platform (except where mandated otherwise by consumer protection law) shall be limited to the amount you paid bucketlistt for the specific booking giving rise to the claim in the twelve (12) months preceding the event.

Without limiting the foregoing, bucketlistt does not guarantee or assume responsibility for the acts, omissions, or conduct of independent Operators, including their staff, equipment, safety practices, or on-site performance of activities.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnity

You agree to indemnify and hold harmless bucketlistt and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform or of customer accounts, fraudulent bookings, violation of applicable laws, or your participation in an activity, except to the extent caused by bucketlistt’s gross negligence or wilful misconduct as finally determined by a competent authority.

13. Intellectual property

The Platform, branding, logos, software, and content provided by bucketlistt are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. Scraping, automated extraction, AI training or model fine-tuning, and commercial reuse of Platform content, listings, or data are prohibited without our prior written permission. Operator-provided media remains subject to their rights and licences granted to bucketlistt for display on the Platform.

14. Third-party links & services

The Platform may link to third-party websites, payment gateways, or maps. Those services are governed by their own terms; bucketlistt is not responsible for their content or practices.

15. Notices

Legal and other notices under these Terms may be sent to you by email, Platform notifications, or SMS where applicable, using the contact details associated with your account or booking. Notices to bucketlistt should be sent to support@bucketlistt.com or such other address as we may designate.

16. Entire agreement

These Terms, together with any activity-specific terms shown at checkout or provided by the Operator and our Privacy Policy, constitute the entire agreement between you and bucketlistt regarding your use of the Platform and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to such subject matter.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

18. Waiver

No failure or delay by bucketlistt in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right preclude any other or further exercise of that or any other right. Any waiver must be in writing and signed by an authorised representative of bucketlistt to be effective.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. bucketlistt may assign or transfer its rights and obligations under these Terms, in whole or in part, in connection with a merger, acquisition, corporate restructuring, sale of assets, or by operation of law, without your prior consent.

20. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to mandatory consumer protection rules, courts at Dehradun, Uttarakhand, India shall have exclusive jurisdiction over disputes arising from these Terms or use of the Platform, unless another forum is required by law.

21. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will be revised, and continued use of the Platform after changes constitutes acceptance of the updated Terms. Material changes may be communicated through the Platform or by email where appropriate.
